Respondents Prayer :- Writ Petition is filed under Article 226 of Constitution of India, pleased to issue a Writ of Mandamus, directing the 6th respondent to take over the investigation in Crime No.317/2014 on the file of the 6th respondent herein and investigate the case by adding the appropriate provision under the SC/ST Act 1989, within the time frame fixed by this Court.

ORDER

This Writ Petition has been filed for directing the 6th respondent to take over the investigation in Crime No.317 of 2014 on the file of the 6th respondent herein and investigate the case by adding the appropriate provision under the SC/ST Act 1989 and file final report. 2/4

2. Without expressing any opinion on the merits of this Writ petition, 6th respondent is directed to complete the investigation in Crime No.317 of 2014 and file final report within a period of 12 weeks from the date of receipt of a copy of this order, if not already filed.

3. It is made clear that, if any material available in order to attract the offence under SC/ST Act, it is needless to say that, the 6th respondent can very well include those offences by filing final report.

4. Accordingly, this Writ Petition is disposed of, with the above direction. Consequently, the connected Miscellaneous Petition is closed. No costs.
