Petitioner has come up with the present Writ Petition seeking to forbear the Respondents or their subordinates from in any manner recovering a sum of Rs.1,28,900/-, alleged to be the transit loss, from his salary.

Heard the learned counsel for the parties and Mr.V.Rajavelu, Manager-Legal of the 1st Respondent Society, who appeared through Virtual hearing.

When the matter was taken up for hearing, learned counsel for the Petitioner submitted that, recovery order has been served on the Petitioner and that, the Writ Petition may be closed with liberty to the Petitioner to challenge the same. https://hcservices.ecourts.gov.in/hcservices/

Mr.C.Munusamy, learned Special Government Pleader appearing for the 1st Respondent submitted that, the 1st Respondent may be permitted to recover the amount from the Petitioner.

This Court is not inclined to render any opinion on the contentions of the learned counsel on either side. However, the Petitioner is at liberty to challenge the recovery order that has been served on him. In case, the said order is not challenged by the Petitioner, it is needless to state that, the 1st Respondent can recover the amount due from the Petitioner.
