ORDER
This writ petition is filed to direct the 1st and 2nd Respondents herein to disburse the compensation amount of the Petitioner, for acquiring his land situated in Ward No.1, Plot No.21, S.No.2037, Measuring to an extent of 95 sq.mts, in Nagapattinam Town and District.
2. Learned counsel for the petitioner would submit that the land in S.No.2037, Plot.No.1, Ward No.1, measuring an extent of 10237 sq.ft., originally belonged to petitioner's father. After his demise, the petitioner has taken possession of the said property. Under these circumstances, the first respondent has acquired an extent of 95 sq.mts, in the above said survey number for the purpose of Chennai-Kanyakumari Industrial Corridor Project. However, till date, the first respondent has not disbursed the compensation amount for the acquired extent of land. Hence, this writ petition.

Learned Additional Government Pleader appearing for the respondents 1 to 3 would submit that a specific performance suit is pending between the petitioner and the respondents 4 to 7, before the District Court, Nagapattinam. Hence, the respondents are not in a position to disburse the compensation to the petitioner.
4. Heard the learned counsel on either side and perused the materials available on record.
5. In the present case on hand, the petitioner is the absolute owner of the property and was in possession of the said property, as on the date of acquisition. Such being the case, the petitioner is entitled for compensation. Moreover, the specific performance suit filed by the respondents 4 to 7 no way prevents the official respondents to disburse the compensation amount to the petitioner.

In view of the above, this Court directs the official respondents to disburse the compensation amount to the petitioner for acquiring the land situated in Ward No.1, Block No.21, S.No.2037, measuring an extent of 95 sq.,mts., in Nagapattinam Town and District, as expeditiously as possible. With the aforesaid observation and direction, this writ petition stands disposed of. No costs.
