This application has been filed to condone the delay of 172 days in filing the application to set aside the ex parte order dated 10.07.2019 against defendants 2 and 5.

2. I heard the learned counsel for the applicants and the learned counsel for the respondents.

3. The learned counsel submitted that the written statement could not be filed because the parties attempted to settle the dispute by holding discussions. Consequently, the applicants were set ex parte. Once again they discussed with a view to reach the settlement among family members resulting in filing the present application.

4. The learned counsel for the respondents has no objection if this application is allowed.

5. Upon consideration of the aforesaid submissions and on examining the affidavit in support of the application, I find that the applicants have made out sufficient cause to condone the delay. Accordingly, the delay of 172 days is condoned by allowing this application.
