Earlier, this Court by an order dated 28.06.2023 dismissed of the above Criminal Original Petition and directed the learned trial judge to complete the trial in C.C.No. 334 of 2021 within a period of four weeks from the date of that order. Since the trial could not be completed within the time stipulated by this court, the petitioner herein sought for modification of condition to complete the trial.

2. Today, when the matter taken up for hearing, learned counsel for petitioner appeared and submitted that the trial is conducted at the day to day basis for production of witness and defence side evidence due to the condition imposed by this court, which leads to hardship for him to provide his effective defence in this case. Hence, he prayed to modify the condition imposed by this court.

3. Considering the request made by the petitioner herein, this Court is inclined to extend time for the period of four months to complete the trial from the date of receipt of copy of this order. 12.02.2024 rpp 2/3
