Prayer :- Criminal Original Petition is filed under Section 482 of Code of Criminal Procedure, to pass an order of direction, directing the respondents 1 to 3 hold enquiry into the complaint of the petitioner dated 23.08.2016 in accordance with law under Section 151 PSO Act to secure the ends of justice. ORDER
This petition is filed seeking direction to the first respondent to hold enquiry into the complaint of the petitioner dated 23.08.2016 in accordance with law under Section 151 PSO Act, to secure the ends of justice.
2.When the matter is taken up for hearing, learned Government Advocate submitted that on the basis of the representation given by the petitioner, Community Service Register in C.S.R.No.388 of 2016 was registered. On enquiry, it was found that the petitioner and respondents have settled the dispute between them and given written undertaking with regard to the settlement. Therefore, it is submitted that, further action on the representation of the petitioner was dropped. 3.Learned counsel for the petitioner submitted that, this report of the respondents is not sufficient in the absence of supporting materials. However, this Court finds that only after the enquiry and finding that, parties have arrived at an amicable settlement and given written undertaking, further action was dropped.
Therefore, this Court is of the view that, nothing survives in this petition, which was filed in the year 2016. If the petitioner is aggrieved against the closure of the enquiry on the complaint of the petitioner dated 23.08.2016, he can workout his remedy in the manner known to law. With this observation, Criminal Original Petition in CRL.O.P.No.27657 of 2016 is disposed.
