Respondents Prayer: Writ petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, calling for the records relating to the order of the 2nd respondent issued in M.M.Noi.89369/D1/1/02, dated 17.04.2004 insofar as restricting the effect of the order from 17.04.2004 converting vacant B.T. Assistant History of the fourth respondent School to that of B.T. Assistant English and quash the same and consequently direct the second respondent to grant conversion of the above post from 05.09.2001 instead of from 17.04.2004 and consequently pay salary and other benefits as B.T. Assistant English to the petitioner from 05.09.2001 onwards.

O R D E R

This petition has been filed to quash the order of the 2nd respondent dated 17.04.2004 in M.M.No.89369/D1/1/02 and consequently pay salary and other benefits as B.T. Assistant English to the petitioner from 05.09.2001 onwards.

2. By an interim order, dated 29.11.2004, this Court had directed the respondents to pay the petitioner's salary from 17.04.2004 within a period of six weeks. Though the name of the petitioner is printed in the cause list, none entered appearance on behalf of the petitioner.

3. Since the petitioner has not chosen to appear before this Court, this Writ Petition is dismissed for default. In case, the petitioner's grievance still subsists for her claim of the salary arrears from 05.09.2001, it is open to her to file a Review Petition before this Court. No costs. Consequently, connected miscellaneous petition is closed.
