Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to (i) To modify the condition imposed in clause (b) The petitioner shall settle the issue by returning the cost of Rs.3,30,00,000/- (Rupess three crores thirty lakhs only) or by way of transferring the property worth about for the said sum, in favor of the de-facto complainant within period of four weeks, failing which the petitioner is directed to surrender before the respondent police on or before 11.02.2019 in the Crl.O.P.No.113 of 2019 dated 11.01.2019. (ii) To extend some more time in the above Crl.O.P.No.113 of 2019 order dated 11.01.2019 to sort out the issue, and comply the condition and pass such further or other orders as may be deemed fit and proper in these circumstances of this case.
Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.A.SAKTHIVEL, Advocate for the petitioner, [IN BOTH THE PETITIONS] and of MR. C. RAGHAVAN, Govt. Advocate ( Crl. Side), on behalf of the Respondents, [IN BOTH THE RESPONDENT] and of M/S.
The Criminal Miscellaneous Petitions have been filed (i) to modify the condition imposed in clause (b) The petitioner shall settle the issue by returning the cost of Rs.3,30,000/- or by way of transferring the property worth about for the said sum, in favour of the defacto complainant within a period of four weeks, failing which the petitioner is directed to surrender before the respondent police on or before 11.02.2019 in Crl.O.P.No.113 of 2019, dated 11.01.2019, (ii) to extend the further time to comply with the condition imposed in Crl.O.P.No.113 of 2019 dated 11.01.2019 in in Crl.O.P.No.113 of 2019.
2. Heard both side.
3. The condition imposed in Crl.O.P.No.113 of 2019 passed by this Court, by an order dated 11.01.2019 extracted is hereunder.- "(b)the petitioner shall settle the issue by returning the cash of Rs.3,30,000/- [Rupees Three Lakh Thirty Thousand Only] or by way of transferring the property worth about for the said sum, in favour of the defacto complainant within a period of four weeks, failing which the petitioner is directed to surrender before the respondent police on or before 11.02.2019".
4. However, the complainant also submitted that the negotiation is going on between the parties.
5. Considering the facts and circumstances of the case, this Court is not satisfied with the reasons submitted by the learned counsel for the petitioner to modify the condition imposed by this court dated 11.01.2019. However, this court is directed the petitioner to comply with the condition imposed in Crl.O.P.No.113 of 2019 passed by this Court, by an order dated 11.01.2019 and further time extended to comply with the same on or before 22.04.2019.
6. Post the Crl.O.P.No.113 of 2019 on 23.04.2019.
7. With the above directions, the Criminal Miscellaneous Petitions are closed.
