Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of Certiorarified Mandamus calling for the records comprised in the proceedings of the First Respondent bearing No.O.Moo.No.12391/A2/09 dated 19.09.2009 and quash the same and consequentially issue a Mandamus directing the respondents to make necessary corrections in the Service Register by changing the date of birth of the petitioner as 25.07.1953.

Today, when the matter is taken up for hearing, learned counsel for the Petitioner submitted that, the Petitioner has sought for alteration of Date of Birth after five years from the date of entry into service and that, the Petitioner has attained superannuation now. Hence, according to the learned counsel for the Petitioner, due to efflux of time, nothing further survives for consideration in this matter.

Recording the said submissions of the learned counsel for the Petitioner, this Writ Petition is dismissed as having become infructuous. No costs. Consequently, connected M.P.No.1 of 2010 is closed.
