ORDER

This Writ Petition has been filed to direct the 1st respondent to consider the petitioner's representation/objection dated 05.01.2026 and thereafter, to conduct a fair enquiry before initiating the survey and demarcation proceedings of the property morefully described in the prayer to this writ petition.

2. Mr.C.Jayaprakash, learned Government Advocate, accepts notice on behalf of the respondents 1 and 2. Since no adverse order has been passed against the 3rd respondent in this writ petition, notice to the 3rd respondent is dispensed with.

3. Earlier, the neighbouring land owner, by name S.John @ John Peter, who is the 3rd respondent herein, had filed a writ petition in W.P.No.46349 of 2025 and in the said writ petition, by order, dated Page No.2 of 7

02.12.2025, this Court had directed the respondent therein to survey and demarcate the boundaries of the very same property, which is the subject of this writ petition. The only grievance of the petitioners in this writ petition is that without hearing the petitioners' objections, an attempt is being made by the official respondents to survey and demarcate the boundaries for the subject property. Hence, the petitioners seek for a direction to the 1st respondent to consider the petitioner's representation/objection, dated 05.01.2026 before surveying and demarcating the boundaries of the subject property as directed by this Court on dated 02.12.2025 passed in W.P.No.46349 of 2025.

4. Necessarily, the objections of the petitioners has to be heard and only thereafter, the official respondents can survey and demarcate the boundaries of the subject property, based on the request made by the 3rd respondent.

5. For the foregoing reasons, this Court directs the 1st respondent to consider the petitioners' representation/objection dated 05.01.2026, before surveying and demarcating the boundaries of the property Page No.3 of 7

morefully described in the prayer to this writ petition, as directed by this Court in its order, dated 02.12.2025 passed in W.P.No.46349 of 2025.

6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
