Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorari, calling for the records of the order passed by the respondent in D.O.888/2006 C.No.A1/19062/2006 dated 03.08.2006 in so far as the petitioner is concerned and quash the same. O R D E R

This writ petition is filed challenging the order of administration issued transferring the writ petitioner.

2. Transfer is an incidental to service, more so condition of service. The public servant can be transferred once in three years as per the transfer policy of the State Government as of now.

3. This apart, administrative transfers can be issued at any point of time, if an administrative exigency arises. An order of transfer can be challenged only on limited grounds and the place and post can never be seen as a matter of right by the Government Employee by taking recourse to the legal proceedings.

4. In view of the fact that the writ petitioner continued in the same place for more than three years, no further consideration is required and the authorities competent are at liberty to take a decision in the matter of transferring the employees. Accordingly, the writ petition stands dismissed. Consequently, connected miscellaneous petitions are closed. No costs.
