O R D E R
The petitioner has filed this writ petition seeking issuance of Writ of Mandamus to direct the respondents 1 to 4 to measure the land purchased by the petitioner and to consider the petitioner's representation dated 29.06.2021 .
2. The case of the petitioner is that he purchased the property in S.Nos.227/18A and 218 at Mottur Revenue Village from one Chinnasamy. While so, respondents 5 to 8, who are the adjacent land owners of the said property, disputed the boundary line of the land belonging to the petitioner. Thereafter, the petitioner approached the 2nd respondent on 10.08.2020 for measuring the land purchased by him and paid a sum of Rs.1,200/-. Subsequently, the petitioner approached respondents 3 and 4 regarding measuring of his land. Since, the respondent 3 to 4 have not taken any steps on the request made, the petitioner made representation dated 29.06.2021 before respondents 1 and 2. However, till date, no order was passed on the representation of the petitioner. Aggrieved by the same, this Writ Petition 2/4
has been filed.
3. Though very many grounds have been raised, learned counsel for the petitioner submits that it would suffice if this Court issues direction to respondents 1 and 2 to consider the petitioner's representation dated 29.06.2021 for measuring the petitioner's property and pass orders on the same within a particular time frame fixed by this Court. 4.The learned Government Advocate has no objection for said order being passed.
5. In view of the aforesaid submissions, this Court without expressing any opinion on the merits of the case directs respondents 1 and 2 to consider the petitioner's representation dated 29.06.2021 for measuring the lands on merits and in accordance with law and pass appropriate orders after affording opportunity of hearing to the aggrieved party including respondents 5 to 8 within a period of twelve weeks from the date of receipt of a copy of this order.
