Prayer:- Writ Petition is filed Under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, calling upon the 4th and 5th respondents to follow the result of entrance examination as depicted in the merit list published by the 4th respondent to the MD (Immuno Haematology And Blood Transfusion) course for the period 2010-2011 and thereby consequently provide the petitioner a seat in the said the course since the petitioner has attained second-rank in the entire merit list and attain first rank from among the non-service candidates and thus entitled to be admitted in the said course.

The writ petition has been filed by the petitioner seeking for issuance of writ of mandamus, calling upon the 4th and 5th respondents to follow the result of the entrance examination as depicted in the merit list published by the 4th respondent to the MD (Immuno Haematology and Blood Transfusion) course for the academic year 2010-2011 and thereby provide a seat to the petitioner in the said course since the petitioner has attained second-rank in the merit list and attained firstrank from among the non-service candidates and thus entitled to be admitted in the said course.
2. The learned counsel appearing for the petitioner submitted that the petitioner has challenged the admission in M.D. degree course for the academic year 2010-2011 and by efflux of time, nothing survives for further adjudication in this writ petition.
3. In view of the above, the prayer made in the writ
petition has now become infructuous and accordingly, the writ petition is dismissed as having become infructuous. No costs.
