Application No. 3470 of 2024 and C.S. No. 52 of 2022 C.V.KARTHIKEYAN, J.

The application has been filed seeking to set aside the exparte order dated 24.01.2024 in the suit.

2. In the affidavit filed in support of the application, it had been stated that the written statement had been filed on 30.09.2022 and it had been returned by the Registry and had been re-presented.

3. It had been stated that in the meanwhile, the matter was listed before this Court on 24.01.2024 and the written statement was not put up before this Court and an exparte order was passed.

4. Taking into consideration the reasons stated, the exparte order is set aside. The petition stands allowed.
