O R D E R

This writ petition has been filed for issue of writ of mandamus directing the 1st and 2nd respondents to consider the representation made by the petitioner on 29.07.2024, wherein, the petitioner has sought for the cancellation of the patta issued in favour of the 3rd respondent.

2.Heard Mr.S.N.Subramani, learned counsel appearing on behalf of the petitioner and Mr.A.Selvendran, learned Special Government Pleader appearing on behalf of respondents 1 & 2.

3.The petitioner is claiming right and title over the subject property. A document came to be registered in favour of the 3rd respondent and based on the same, the patta was also issued in the name of the 3rd respondent in Patta Nos.11089 and 11090. The petitioner questioned the genuineness of the very 2/5

document that was relied upon by the 3rd respondent and the District Registrar had also directed for the cancellation of the document. The petitioner made a representation seeking for the cancellation of patta issued in favour of the 3rd respondent. On receipt of the same, the 1st respondent directed the 2nd respondent to conduct an enquiry and to place the report before the 1st respondent. Since the same was not acted upon, the present writ petition has been filed before this Court. 4.Taking into consideration the facts and circumstances of the case and without going into the merits of the case, there shall be a direction to the 1st respondent to deal with the representation made by the petitioner dated 29.07.2024, after affording opportunity to the 3rd respondent and pass orders on its own merits and in accordance with law, within a period of six weeks from the date of receipt of copy of this order.
