PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to withdraw the M.C.No.200/2011, pending on the file of the learned Additional Family Court, Coimbatore and transfer the same to competent Court within the District Court campus.

O R D E R

This Criminal Original Petition has been filed for transfer of the proceedings pending on the file of the Additional Family Court, Coimbatore in M.C.No.200/2011. 2.The main grievance expressed by the petitioners is that the interim maintenance was granted in favour of the petitioners by the Principal Family Judge, Coimbatore, by order dated 07.12.2016 and the respondent was directed to pay a sum of Rs.10,000/- [Rupees ten thousand only] to the 1st petitioner and Rs.20,000/- [Rupees twenty thousand only] to the 2nd petitioner every month. This order was challenged before this Court in CMA No.1152/2017 and this Court directed the respondent to deposit 50% of the maintenance amount within four weeks as a condition for the grant of interim stay.

The grievance of the petitioners is that this order was not complied with by the respondent and inspite of the same, no effective steps were taken by the Court below to proceed further with the case. Hence, this transfer petition has been filed before this Court. 3.Taking into consideration the facts and circumstances of the case, there shall be a direction to the Additional Family Court, Coimbatore, to dispose of the proceedings in MC No.200/2011, within a period of two months from the date of receipt of copy of this order. The Court below shall also take effective steps to recover the interim https://hcservices.ecourts.gov.

This criminal original petition is disposed of with the above direction.
