Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent to entertain the Stay Petition dated 28.12.2021 filed by the Petitioner along with the Cinema Appeal preferred against the orders dated 04.12.2021 in R.O.C.No.22343/2017 on the files of the 2nd respondent within a reasonable time to be fixed by this Court.

O R D E R

The prayer in this writ petition is for a direction to the 1st respondent i.e., The Additional Land Commissioner (Cinemas and Regulations) to entertain the stay petition dated 28.12.2021 along with the Cinema Appeal preferred against the orders of the 2nd respondent i.e., The District Collector (Licensing Authority) dated 04.12.2021.

Mr.Vadivelu Deenadayalan, learned Additional Government Pleader has obtained written instructions in Roc.No.C2/1829628/2021, dated 01.03.2022, wherein, R-1 confirms https://hcservices.ecourts.gov.in/hcservices/

that the request for grant of stay is under process and will be disposed within a period of 12 weeks following due procedure.

Since the petitioner would request that he be heard prior to the disposal of the stay petition, let notice be issued to the petitioner and the petitioner heard prior to disposal of the stay petition as well. The undertaking given in communication dated 01.03.2022 is noted and recorded, to the effect that the outer time limit for disposal of both the stay petition and the appeal shall be 12 weeks from today.

4. This Writ Petition is disposed in the aforesaid terms. Consequently, the connected Writ Miscellaneous Petition is closed. No costs.
