O R D E R
The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the respondents to designate the petitioner's Professor with effect from 05.07.2017 and issue necessary orders confirming under CAREER ADVANCEMENT SCHEME of the respondents University pursuant to the University Letter No.AU/CAS/ 2018 dated 08.08.2018 with stipulated period. 2.The learned counsel appearing for the petitioner submitted that the petitioner is qualified with Ph.D. in Marine Biology and was appointed as Lecturer in Centre of Advanced Studies in Marine Biology in the Annamalai University with effect from 01.07.2022 and was promoted as Senior Grade Lecturer on 05.07.2006 and moved to the next AGP with effect from 05.07.2011 and was granted movement of Associate Professor under Career Advancement Scheme with effect from 05.07.2014, however, the promotion of Professor under Career Advancement Scheme was not considered by the respondents. 2/6
3.The learned counsel appearing for the petitioner further submitted that the respondents issued notification dated 08.08.2018, inviting applications under Career Advancement Scheme for Assistant Professor Stage 3 to Associate Professor Stage 4 and Associate Professor Stage 4 to Professor Stage 5. Though the petitioner possess the necessary qualification for the post of Professor, he have been denied promotion to the post of Professor. The learned counsel further submitted that similarly placed persons like the petitioner filed W.P.No.653 of 2021 seeking direction to the respondents to consider their representation dated 03.12.2020 with regard to the pending Professor promotion under Career Advancement Scheme and pursuant to the order dated 18.01.2021 made in the said writ petition, the respondents passed an order dated 30.04.2021 rejecting the claim of the petitioner.
4.The learned counsel appearing for the petitioner further submitted that challenging the order dated 30.04.2021, the petitioner preferred W.P.No.14430 of 2021 and this Court vide order dated 27.04.2022, dismissed the said writ petition and aggrieved by the same, similarly placed persons like the petitioner preferred 3/6
W.A.Nos.1807 of 2022 etc., batch and the Hon'ble Dvision Bench of this Court vide judgment dated 13.07.2023 allowed the said writ appeals and challenging the same, the respondents preferred SLP and the SLP was dismissed by the Hon'ble Apex Court and aggrieved by the same, the respondents filed Review Applications before this Court in Review Application Nos.105 of 2024 etc., batch, and the same were disposed of based on the submission made by the learned Additional Advocate General who appeared on behalf of the review applicants that 'in pursuant to the order of this Court, enquiry committee completed the enquiry and submitted its report'. Hence, this Court may issue direction to the respondents to comply with the order passed by the Hon'ble Division Bench of this Court in W.A.Nos.1807 of 2022 etc., batch, dated 13.07.2023.
5.The learned counsel appearing for the respondents submitted that if the petitioner is otherwise eligible, he will be considered for promotion to the post of Professor under Career Advancement Scheme in terms of the Judgment of the Hon'ble Division Bench of this Court in W.A.Nos.1807 of 2022 etc., batch, dated 13.07.2023.

6.In view of the submission made by the learned counsel appearing for the respondents, this Court directs the respondents to extend the benefit of the Judgment of the Hon'ble Division Bench of this Court in W.A.Nos.1807 of 2022 etc., batch, dated 13.07.2023, if the petitioner is otherwise eligible.
