ORDER

This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 10.05.2022 for the alleged offences punishable under Sections 8(c) r/w 20(b)(ii)(C), 25 & 29(1) of Narcotic Drugs and Psychotropic Substances Act, 1985. in Crime No.19 of 2022 on the file of the respondent police, in Spl.C.C.No.87 of 2022 pending

on the file of the Special Judge for EC and NDPS Act Cases, Salem, seeking bail.

2. The case of the prosecution is that on 09.04.2022, A1 was found transporting 100 kgs. of Ganja in a Tata Indigo Car and on enquiry, it was found that only on the instruction of the petitioner and other accused viz.A2 to A5, A1 had purchased the contraband from Andhra Pradesh and transported the same to sell the same for their personal gain. Hence, this case.

3. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution. Further, he submits that the investigation is completed in this case and also the contraband was not recovered from this petitioner. Hence, he prays to allow this petition.

4. The learned Government Advocate (Crl. side) submits that the petitioner is a habitual offender and the petitioner is having 9 NDPS cases. Hence, he raised objection to grant bail.

5. Considering the facts and circumstances of the case and also the fact that the petitioner is having 9 previous cases and also the contraband seized from the accused person is commercial quantity.
