PRAYER : Petition filed under Article 226 of the Constitution of India praying to issue a writ of Mandamus directing the respondents to select and appoint the petitioner as Graduate Assistant, bearing employment registration No.WPE/4491/92, for Government Middle/High/Higher Secondary School 2009-2010 through Employment Registration Seniority as against the quota for Scheduled Caste and pass such further or other as this Court may deem fit and proper in the circumstances of the case. O R D E R
This writ petition relates to a notification issued in the year 2009 in respect of the appointment of Graduate Assistant.
2. I heard the learned counsel for the Petitioner and the learned Special Government Pleader (Education) for the Respondents.
3. The learned counsel for the Petitioner submitted that the petitioner obtained a B.Com degree in the year 1989 from the University of Madras and also obtained a B.Ed. Qualification. On that basis, the Petitioner had registered herself with the Employment Exchange and wanted to be considered for appointment as B.T. Assistant. However, she was not sponsored by the Employment Exchange. Therefore, the writ petition was filed.

In response, the learned Special Government Pleader submitted that the petitioner was not sponsored by the Employment Exchange in view of the fact that she had a degree in Commerce and there were no vacancies for the post of B.T. Assistant (Commerce). He further submits that the requirements for recruitment as B.T. Assistant have changed considerablely since then and, therefore, nothing survives for adjudication in the present writ petition.

Upon considering the submissions of the learned counsel for the respective parties and examining the materials on record, it is seen that the Petitioner was 44 years old at the time when the writ petition was filed and would be about 54 years now. In addition, it is stated that she was not sponsored on account of the non-availability of vacancies for the post of B.T. Assistant (Commerce).
6. In light of the aforesaid facts and circumstances, I am of the view that nothing survives for adjudication in this writ petition at this point of time. Accordingly, the writ petition is disposed of. Consequently, the interim order granted earlier in M.P.No.1 of 2010 shall stand vacated and the said Miscellaneous Petition is closed. No costs.
