C.M.P.Nos.8139, 90 to 92 of 2018 in A.S.SR.No.34099 of 2018 S.M.SUBRAMANIAM.,J These petitions are filed to condone the delay of 89 days in preferring the appeal; to condone the delay of 516 days in filing the petition to set aside the abatement; to set aside the abatement caused due to the death of the 2nd respondent and to bring on record the proposed parties 4 and 5 as legal heirs of the deceased 2nd respondent in the first appeal.

2.This Court is satisfied with the reasons stated in the supporting affidavit. The petition in C.M.P.No.8139 of 2018 to condone the delay of 89 days in preferring the appeal is ordered and the delay is condoned on condition to pay a sum of Rs.500/-(Rupees Five Hundred only) to the High Court Legal Services Authority, on or before 31.01.2020, failing which, this petition would stand dismissed automatically. The petition in C.M.P.No.90 of 2020 to condone the delay of 516 days in filing the petition to set aside the abatement is ordered and the delay is condoned. The abatement caused due to the death of the second respondent is set aside and C.M.P.No.91 of 2020 is allowed. Proposed respondents 4 and 5 are ordered to be brought on record as legal representatives of the deceased second respondent in the Appeal and the petition in C.M.P.No.92 of 2020 is allowed. 22.01.2020 http://www.judis.nic.in ssb
