JUDGMENT

(Judgment of the court was delivered by R. MAHADEVAN, J.) This Writ Appeal arises from the order dated 07.10.2022 passed by the learned Judge in W.P.No.26974 of 2022.

The respondent herein filed the aforesaid writ petition challenging the order dated 17.08.2022 passed by the third appellant, rejecting the proposal seeking approval of his appointment as Middle School Headmaster in the second respondent school with effect from 15.02.2021 in the existing vacancy, based on the service rendered by him as BT Assistant (English) at Deccan Matriculation School. By order dated 07.10.2022, which is impugned herein, the learned Judge allowed the writ petition by setting aside the order passed by the appellant authorities and by remitting the matter for passing fresh order in the light of the consent given by Mr.N.Sudhakar, B.T Assistant (Tamil) relinquishing his right to promotion as the Headmaster of the school vide letters 2/4

dated 01.06.2019 and 29.09.2022. Aggrieved by the same, the appellants are before this court with the present writ appeal.

However, today, when the matter was taken up for consideration, the learned Special Government Pleader appearing for the appellants produced a copy of the proceedings in Na.Ka.No.163/A4/2022 dated 21.07.2023, wherein, it is inter alia stated that following the decision rendered by the very same Bench earlier in The Director of School Education D.P.I. Campus, College Road, Chennai vs M. Velayutham (W.A.No.313 of 2022 etc., batch decided on 02.06.2023), the proposal for appointment of the respondent / writ petitioner as Headmaster in the respondent school with effect from 15.02.2021 was approved, subject to certain conditions.

4. In the light of the proceedings so passed by the appellant authorities, this court is of the opinion that since the order impugned herein, has been complied with, nothing survives for further adjudication. Therefore, this writ appeal stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
