This Petition has been filed under Section 232 and 276 of the Indian Succession Act 1925, seeking grant of Letters of Administration with Will annexed relating to the Will dated 12.05.2021 executed by the sister of the first petitioner and the paternal aunt of the second petitioner, by name A.Nagamani, who died on 18.05.2021.

After following due procedure, the petitioners were invited to tender evidence. The second petitioner examined herself as PW-1. The Original Will dated 12.05.2021 was marked as Ex.P3, the death certificate of A.Nagamani was marked as Ex.P-4 and the affidavit of assets was marked as Ex.P-5. Thereafter, the petitioner also examined Suresh Kumar as PW-2, who was one of the attesting witness along with one C.Chandramouli. He stated that the testatrix signed the Will in his and in the presence of C.Chandramouli and also stated that she was in a sound and disposing state of mind. He identified the Will under Ex.P-3. His affidavit was marked as Ex.P-8.

The Court wanted the documents relating to the relationship between the petitioners and the deceased and accordingly, the pancard of the deceased and the pancard of the first petitioner were produced during the course of arguments. They were marked as Exs. P-9 and P-10 respectively. It shows the name of the father Subbanna Sela.
4. In view of the evidence presented, this Original Petition stands allowed as follows:- (a) the letters of administration shall be issued in favour of the petitioners in respect of the properties mentioned in the petition.
(b) The petitioners are directed to duly administer the said properties of the deceased.
(c) The petitioners are also directed to execute a security bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) in favour of the Assistant Registrar (O.S-II), High Court, Madras. (d) The petitioners are further directed to render true and correct accounts once in a year.
