Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the remuneration for the month of May 2012 by "Quash" the impugned reply letter dated 20.04.2023 of the respondent - 04 and consequently direct the respondents 3 & 4 to "Submit the valid document proof for Rs.10,000/- remuneration/stipend paid to me for the month of May 2012 as per the reply submitted by respondent - 03 dated: 05.11.2021 in Assistant Labour Commissioner (Central) Chennai". This Writ Petition has been filed in the nature of a Certiorarified Mandamus seeking records relating to the remuneration paid to the petitioner by way of stipend for the month of May 2012 as given by the letter dated 20.04.2023 by the fourth respondent. 2.The petitioner has appeared in party in person. He worked as a Financial Services Executive, contractual employee, in Life Insurance Corporation at Salem South Branch and Mettur Dam Branch. He was paid 2/7
stipend of Rs.10,000/- every month. There was various issues between the petitioner and respondents. This Court need not examine those issues at this stage. The only issue is with respect to the stipend paid for the month of May 2012. The respondents had paid a sum of Rs.7,419/- The petitioner has received a sum of Rs.7,419/-. There is no doubt raised either by the petitioner or by the respondents over this particular amount of Rs.7,419/-. 3.But however, there were also proceedings before the Assistant Labour Commissioner, Central, at Chennai, on a complaint filed by the petitioner herein. While filing a reply to that particular complaint, the respondents had also filed an annexure, giving the amounts paid as stipend to the petitioner.
In that particular annexure, the respondents had stated that the amount paid for the month of May 2012 to the petitioner was Rs.10,000/-. This has necessitated the filing of the writ petition. 4.In the writ petition filed, the petitioner claims proof for payment of Rs.10,000/-, while actually the respondents had paid only Rs.7,419/-. This amount of Rs.
communication, dated 20.04.2023, which is impugned in this particular writ petition. In that particular communication, with specific reference to stipend paid for May 2012, it had been stated that for one month, the stipend is Rs.10,000/- and in May 2012, the petitioner had worked from 09.05.2012 till 31.05.2012 for a total period of 23 days and therefore, since the monthly stipend is Rs.10,000/-, the daily stipend comes to Rs.322.58 and for 23 days, it come to Rs.7,419.354 rounded off to Rs.7419/-, which is the amount paid by cheque No.666067 dated 01.06.2012. There is no dispute about the payment of Rs.7,419/- to the petitioner. The petitioner however seeks proof as to how the respondents mentioned Rs.
10,000/- in the annexure to the reply filed in the complaint given by the petitioner before the the Assistant Labour Commissioner, Central, at Chennai. There is no proof for the same. 5.It is an amount mentioned in the annexure. If that particular amount is wrong, then the petitioner will have to take up that particular issue only before the Assistant Labour Commissioner, Central, at Chennai, since, the said detail was given before the said forum and not before this Court.
Rs.7,419/- for May 2012 to the petitioner and the petitioner also admits that he received Rs.7,419/- in May 2012. If an amount of Rs.10,000/- had been mentioned before the Assistant Labour Commissioner, Central, at Chennai and if that amount of Rs.10,000/- is wrong both to the knowledge of the petitioner and to the knowledge of the respondents, then necessary clarification will have to be issued only before the said forum, where the said communication was given, namely, the Assistant Labour Commissioner, Central, at Chennai. It is beyond the purview of this Court to examine the correctness of details given before another judicial forum. It is for that forum to examine the details given therein. I am not inclined to grant the relief sought.
6.With the above observations, this Writ Petition stands dismissed. No costs. Consequently, connected miscellaneous petitions, if any, are also closed.
