Prayer: Criminal Original petition is filed under Section 482 of Cr.P.C, to direct the respondents herein, to forbear them from giving police protection in any manner aiding the officials of the Power Grid Corporation Limited & the Revenue Officials in implementing the "800 kV Raigarh (HVDC Stn) - Pugalur (HVDC Stn) HVDC Bipole link with MW capacity", unless those Officials obtain Enter-upon Permission under the Provisions of the "Indian Telegraph Act, 1885" or "Works of Licensees Rules, 2006" as the case may be, from the District Magistrate, Salem, permitting Entry in to the Lands of the Petitioners.

ORDER

This petition has been filed questioning the action taken by the Power Grid Corporation Limited, seeking to take over the lands belonging to the petitioners for the purpose of putting up a power grid with the help of police.

2. In a case of similar nature, this Court has already passed an order in Crl.O.P.No.28520 of 2018, dated 06.12.2018. The relevant portion of the order is extracted hereunder: "10.This Court has carefully considered the submission made on either side. The learned Senior counsel appearing for the seventh respondent has made a categorical statement before this Court that the seventh respondent will not proceed further, where there is resistance from the land owners/occupiers, without following the procedure under Section 16(1) of the Indian Telegraph Act, 1885. In view of the specific stand taken by the

learned Senior counsel, the apprehension that has been raised by the petitioners has been answered. 11.It is made clear that the police shall not interfere in this issue unless the seventh respondent has followed the procedure in accordance with law in order to proceed further with the project. This Court also records the submission made by the learned Senior counsel appearing for the seventh respondent in this regard."

3. The above order will also apply to the facts of the present case. The 7th respondent is directed to follow the procedure under Section 16(1) of the Indian Telegraph Act, 1885 and workout his remedy in accordance with law. It is made clear that the police will not interfere with this issue, unless the 7th respondent has followed the procedure in accordance with law in order to proceed further with the project.

4. With the above observation, the Criminal Original Petition is disposed of.
