ORDER
The petitioner, who was arrested and remanded to judicial custody on 22.12.2025 for the offences punishable under Sections 8(b) r/w 20(a)(i) of NDPS Act, in Crime No.741 of 2025 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that on 22.12.2025 at about 11.00 a.m., when the respondent police was on regular patrol duty, they found the petitioner was in possession of 151 grams of Ganja and on enquiry they also found that two Ganja plants were cultivated in his house. Hence the complaint. 3.The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that the petitioner is in custody from 22.12.2025 and there is no previous cases pending against the petitioner and he is in judicial custody for more than 35 days. Hence, he prayed for the grant of bail to the petitioner. 4.The learned Government Advocate (Crl.
Side) would vehemently oppose to state that the petitioner was found to be in possession of 151 grams of Ganja and that during enquiry, it was found that the petitioner was also cultivating two GANJA plants in his house. He would further submit that the petitioner was arrested on 22.12.2025 and he has no previous cases against him. 5.

Accordingly, the petitioner is ordered to be released on bail on his executing bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each, for a like sum to the satisfaction of the learned the Judicial Magistrate No.I, Dharmapuri and on further conditions that: (a) the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
(b) the petitioner shall appear before the respondent police everyday at 10.30 a.m. for the period of three weeks and thereafter as and when required for interrogation; (e) the petitioner shall not tamper with evidence or witness either during investigation or trial;
(f) the petitioner shall not abscond either during investigation or trial;
(g) on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala
[(2005) AIR SCW 5560]; and;
(h) if the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
