Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to Writ of Certiorarified Mandamus calling for the records of the respondent in connection with the impugned orders passed by the 2nd respondents in RC.No. 74169/NGBIV (1)/2005 dated 16. 8.2005 and consequential memorandum issued in Rc.No. 150525 NGB I (1) /2008 dated 19.12.2008 and quash the same and further direct the respondents to consider the claim of the petitioners for including their names in the "C" list of Sub-Inspectors fit for promotion as inspectors of police for the year 2008-09 and promote the petitioners as Inspector of Police with all consequential service benefits For Petitioners : Mr.K.Venkataramani Senior Counsel for M.Muthappan For Respondents : Mr.S.John J. ORDER

As far as petitioner 1, 3 and 4 are concerned, the counter affidavit at para 16 states that they had, as early as in 2010, submitted petitions to the 2nd respondent i.e. the Director General of Police to the effect that they do not wish to pursue the writ petition and would withdraw the same. Copies of letters, stated to have been filed by the aforesaid petitioners, are placed on record.

2. As far as the 2nd and 5th petitioners are concerned, learned Senior Counsel would submit that the learned counsel on record has instructions to the effect that they have retired from service (P2 on 30.09.2011) and hence do not wish to pursue this writ petition. The learned counsel on record has filed a memo dated nil under cover of e.mail dated 22.09.2021 to the aforesaid effect.

3. Recording the aforesaid, this writ petition is dismissed as withdrawn. Connected miscellaneous petition is closed. No costs.
