JUDGMENT

(JUDGMENT OF THE COURT WAS DELIVERED BY R. SUBBIAH, J) The appellant has come forward with this appeal aggrieved by the order dated 18.06.2015 passed in F.C.H.M.O.P. No. 8 of 2014 on the file of Family Court, Udhagamandalam. By the said order, the petition filed by the appellant under Section 13 (1) (ia) of The Hindu Marriage Act for dissolution of the marriage dated 28.05.2009 solemnised between him and the respondent on the grounds of cruelty was dismissed.

Today, when the appeal is taken up for hearing, the learned counsel appearing for the appellant filed a Memo dated 17.07.2017 stating that the appellant died on 08.07.2016 in a motor accident. He has also produced the death certificate of the appellant along with the memo.
