Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 4(1) (aaa) r/w 4(1-A) of TNP Act, in Crime No.767 of 2019 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that when the respondent police was on regular checkup, the petitioner was found in illegal possession of 2746 bottles of brandy along with 120 litres of Pondy Arrack. Hence the complaint.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case and prays for grant of bail to the petitioner.

4. The learned Government Advocate (Criminal Side) submitted that the petitioner is found in illegal possession of 2746 bottles of brandy along with 120 litres of Pondy Arrack. He further submitted that the investigation is still pending. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the fact that the quantum of brandy which was transported in the alleged occurrence is in the higher side, if these petitioners are released on anticipatory bail they may try to tamper the witness and hamper the investigation, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
