ORDER

[Order of the court was made by M.JAICHANDREN, J.,] The petitioner, the mother of the detenue, Roja, has filed this Habeas Corpus Petition, to cause production of her daughter, who is said to be missing, before this Court and to set her at liberty.

When the case was taken up for hearing, there is no representation on behalf of the petitioner. Heard the learned Additional Public Prosecutor appearing for the respondent. We have also perused the records placed before us, carefully. The petitioner would state that her daughter, Roja, had been missing from 19.06.2015. Therefore, a complaint had been lodged before the respondent police, on 20.06.2015. Since the said complaint has not been registered, the petitioner sent https://hcservices.ecourts.gov.in/hcservices/

another complaint, on 12.08.2015, which was acknowledged, on 13.08.2015 and no F.I.R has been registered, till date. As the whereabouts of the detenue are not known, till date, and having no other alternative remedy, the petitioner is before this Court, with this Habeas Corpus Petition. The learned Additional Public Prosecutor appearing on behalf of the respondent police, on instructions, would submit that the detenue, viz., Roja, had eloped with a person of her choice and that steps are being taken to trace the detenue. In such circumstances, this Court is of the considered view that no useful purpose would be served in keeping the petition pending on the file of this Court. Accordingly, the Habeas Corpus Petition stands closed. However, it is made clear that liberty is given to the petitioner to approach the respondent police to know about the further progress in the investigation of the case.
