Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the 4th Respondent to proceed the petitioner's check slip and release retirement benefit of Rs.21,72,760/- along with 18% interest to the petitioner without insisting NOC from the 3rd Respondent society by considering the petitioner's representation dated 17.12.2025 within a reasonable period to be fixed by this Hon'ble Court. ORDER

The present Writ Petition has been filed seeking a direction to the 4th Respondent to proceed with the petitioner's check slip and release retirement benefit of Rs.21,72,760/- to the petitioner along with interest at the rate of 18% without insisting for NOC from the 3rd Respondent society by considering the petitioner's representation dated 17.12.2025 within the reasonable time that may be stipulated by this Court.

2. It is the case of the petitioner that, despite his retirement from service as driver in the 4th respondent office on 31.05.2025, his terminal benefits were not settled. In this regard, the petitioner earlier approached this

Court by filing W.P.No.13528 of 2025 wherein this Court, vide order dated 24.06.2025, directed the respondents to consider the petitioner's representation seeking disbursement of terminal benefits. Pursuant thereto, a sum of Rs.6,17,500/- alone was disbursed to the petitioner on the ground that he had stood as surety in respect of the loan obtained from the 3rd respondent society by one Srinivasan who was working as Conductor who was later removed from service without settlement of his terminal benefits. Aggrieved by such partial disbursement, the petitioner submitted a detailed representation dated 17.12.2025 to the respondents seeking release of the remaining terminal benefits along with interest at the rate of 18% per annum. However, till date, the said representation has not been considered. Hence, the present Writ Petition.

Learned counsel appearing for the petitioner submitted that, in view of the reply letter dated 17.11.2025 issued by the 3rd respondent, the total amount due and payable by the principal borrower, as on date, is a sum of Rs.7,07,605/-. Therefore, this Court may issue a direction to the respondents to settle the terminal benefits payable to the petitioner however. Insofar as the said outstanding dues, the petitioner may be permitted to work out hiss remedy before the appropriate forum.

4. On the above contention, this Court, heard the learned Counsel appearing for the respondents 1 & 2 who has no objection to the said order being passed.

In view of the above, there shall be a direction to the respondents to settle the terminal benefits to the petitioner excluding a sum of Rs.7,07,605/- payable by the principal borrower within a period of twelve (12) weeks from the date of receipt of a copy of this order. However, liberty is granted to the petitioner to initiate appropriate proceedings for recovery of the said sum of Rs.7,07,605/- in the manner known to law.

6. This Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs.
