These petitions are filed to condone the delay of 666 days in filing the petition to set aside the abatement caused due to the death of the 9th respondent in the appeal suit; To set aside the abatement caused due to the death of the 9th respondent in the appeal suit; To bring on record the following persons viz., i) Rathnasamy, Son, S/o.Late Chinna Ramasamy, ii)Sri Raja Rajeshwari(Daughter) D/o.Late Chinna Ramasamy Gounder, (iii) Marudhachalam(Son), S/o.Late Chinna Ramasamy Gounder, All are residing at 5/72/1, Cheyur South, Cheyur Village, Avinashi Taluk as Legal Representatives of the deceased 9th respondent as respondent 10 to 12 in the appeal suit.
2. Being satisfied with the reasons stated in the accompanying affidavits filed in support of these civil miscellaneous petitions. The petition in C.M.P.No.3606 of 2020, to condone the delay of 666 days in filing the petition to set aside the abatement caused due to the death of the 9th respondent is allowed and the delay stands condoned. http://www.judis.nic.in 1/2

3. The abatement caused due to the death of the 9th respondent is set aside and C.M.P.No.3607 of 2020 is allowed. Respondents 10 to 12 are ordered to be brought on record as legal representatives of the deceased 9th respondent as respondents 10 to 12 in the appeal suit and the petition in C.M.P.No.3609 of 2020 is allowed.
27.02.2020 Kak Note: Registry is directed to carry out the necessary amendments and post the appeal suit after two weeks.
