2. This Court is convinced with the reasons stated in the affidavit filed in support of the petition. Even though the petitioner has given sufficient reasons, this Court is of the view that the petitioner could have avoided the delay of 642 days through due diligence. Hence, this petition is ordered on condition that the petitioner shall pay a sum of Rs.5,000/- to the respondent towards costs within a period of two weeks from the date of receipt of a copy of this order.

3. Registry is directed to number the restoration petition and list the same before this Court, if it is otherwise in order.
