This Civil Miscellaneous Petition has been filed to condone the delay of 246 days in filing the above appeal.

2. Heard the learned counsel for the petitioners.

3. Despite the receipt of notice, the 3rd respondent neither appeared nor entered appearance through his counsel.

4. The petitioner would aver that due to the following reasons, delay of 246 days occurred in preferring this Civil Miscellaneous Appeal: i. On account of the accident, she lost her husband on 18.07.2014. ii. Due to the ill health of the parents of the deceased, she was unable to contact her trial court counsel.

iii. And because the bundle was mixed with other bundles and missing.

Accepting the averments made by the petitioners in the affidavit enclosed with the petition, this Court is inclined to allow this Civil Miscellaneous Petition subject to the condition that the interest for the delay period of 246 days shall stand waived.
