Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the respondent to grant all necessary approvals to the drawings, project plans and other related proposals of the petitioner pursuant to the various letters addressed by the petitioner on 17.10.2018, 23.10.2018, 23.11.2018, 04.12.2018 and 10.01.2019; consequently directing the respondent to release all preliminary payments to the petitioner in accordance with the terms of the contract; and further directing the respondent to issue communications to the authorities in the 10 cities for ensuring access to the petitioner to the sites for the project and for all further activities for the implementation of the project.

O R D E R

The petitioner has come up with this Writ Petition seeking a direction to the respondent to grant all necessary approvals to the drawings, project plans and other related proposals of the petitioner pursuant to various letters addressed by the petitioner on 17.10.2018, 23.10.2018, 23.11.2018, 04.12.2018 and 10.01.2019; and for a consequential direction to the respondent to release all preliminary payments to the petitioner in accordance with the terms of the contract and further direct the respondent to issue communications to the authorities in the 10 cities for ensuring access to the petitioner to the sites for the project and for all further activities for the implementation of the project.

2. When the matter is taken up for hearing, the learned Government Pleader produced a communication of the respondent dated 25.01.2019 in Letter No.TUFIDCO/ICCC/738/AM (M)/2017, by which the Commissioner of Municipal Administration was requested to cooperate with the L & T officials and proceed ICCC projects under Smart Cities Mission as per the direction of this Court. The same is recorded.

3. As the respondent have already requested the Commissioner of Municipal Administration to redress the grievance of the petitioner vide the aforesaid communication, this Writ Petition is closed. No costs.
