This Criminal Original Petition filed under Section 482 of Cr.P.C, praying to modify the condition passed by the Principal District & Sessions Judge, Coimbatore in Crl.M.P.No.3940 of 2018, dated 07.01.2019 directing the petitioners shall appear before the Judicial Magistrate Additional Mahila Court, Coimbatore daily at 10.30 a.m until further orders.

ORDER

This Criminal Original Petition has been filed seeking for modification of the condition imposed by the Court below. 2.

The respondent Police have registered an F.I.R in Crime No.11 of 2018 for the offence under Section 498(a) and 506(i) of IPC. These petitioners have been shown as A4 and A5. 3.

The petitioners filed an Anticipatory Bail petition before the Court below and the Court below on consideration of the facts and circumstances of the case granted Anticipatory Bail by imposing conditions. The petitioners are aggrieved with the condition that they have been directed to appear before the https://hcservices.ecourts.gov.in/hcservices/

Judicial Magistrate, Additional Mahila Court, Coimbatore daily at 10.30 a.m.

The learned counsel for the petitioner submitted that the 1st petitioner is the sister-in-law and the 2nd petitioner is the sister of mother-in-law and they have nothing to do with the offence. The learned counsel further submitted that they are permanent residents of Guduvancherry and Arupukottai respectively and they are not in a position to comply with the said condition.

This Court is of the considered view that the condition imposed by the Court below is onerous. In the facts and circumstances of the case, it is enough, if the petitioners appear before the respondent Police as and when required. Therefore, the condition imposed by the Court below is modified accordingly.

This Criminal Original Petition is disposed of, with the above modification.
