ORDER

This Criminal Original Petition has been filed to call for the records relating to the proceedings in CC.No.234/2020 on the file of the Judicial Magistrate II, Dharmapuri and to quash the same insofar as the petitioner is concerned.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondents and perused the materials available on records.

3. On a reading of the materials available on record, including the statement of witnesses, complaint and final report, it is seen that that there are prima facie allegations available as against the petitioner, who has been arrayed as A.11. Further, the grounds raised by the petitioner for quashing the case are nothing but defence, and the same can be agitated during the course of trial before the trial Court. Considering the submissions made by the learned counsel 2/4

on either side and also considering the facts and circumstances of the case, this Court is not inclined to quash the case.
