Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Declaration that the action of the third respondent in denying wages to the petitioner by continuing the illegal lay off declared with effect fom 26.04.2003 during the pendency of the industrial dispute No.1/2002 before the Special Tribunal, Chennai - 600 006 under the guise of suspension of operation work vide notice dated 06.07.2003 as illegal, contrary to the provisions of the ID Act 1947 more particularly Sections 22, 25M and 33 and consequently direct the third respondent to continue to pay full wages to the petitioner with effect from 26.4.2003 after adjusting the 50% lay off compensation paid for the period from 26.4.2003 to 06.7.2003 till such time the third respondent comply with the provisions of the ID Act, 1947.
