(CR.NO.733 OF 2018) Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition that "the petitioner shall appear before the Additional Chief Judicial Magistrate Court, Kumbakonam daily at about 10.30 a.m until further orders" in order dated 19.12.2018 made in Crl.O.P.No.28657 of 2018 by this Hon'ble Court.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.K.T.S.SIVAKUMAR, Advocate for the petitioner and of M/S.S.THANKIRA, Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- This Court, while granting bail to the petitioner vide order dated 19.12.2018, made in Crl.O.P.No.28657 of 2018, imposed a condition to the effect that he should report before the learned Additional Chief Judicial Magistrate, Kumbakonam, daily at 10.00 a.m., until further orders. Seeking to relax the same, the present Miscellaneous Petition has been filed.

2. The learned counsel for the petitioner submitted that the petitioner has been regularly complying with the conditions imposed by this Court vide order dated 19.12.2018, made in Crl.O.P.No.28657 of 2018. The said submission has been fairly conceded by the learned Government Advocate (Criminal side).

3. Considering the facts and circumstances of the case and also the fact that the petitioner has been regularly complying with the conditions without fail, the condition imposed on 19.12.2018 is modified to the effect that the petitioner shall appear before the learned Additional Chief Judicial Magistrate, Kumbakonam, once in a week i.e. on every Monday at 10.30 a.m., until further orders. Any non-compliance of this order by the petitioner, if noticed, the earlier bail order shall be cancelled automatically.
