..Respondents Prayer:- Criminal Original Petition filed under Section 482 Cr.P.C praying for direction to transfer the Investigation to the 3rd respondent from 2nd respondent pending in Cr.No.1/2016 on the file of the Inspector of Police, EOW - II and consequently direct the 3rd respondent to investigate the case expeditiously according to the law and to file the final report within stipulated period.

O R D E R

The learned Additional Public Prosecutor on instructions submitted that there are 2048 depositors and that the respondents have identified most of the properties of the accused.

2. It is the case of the petitioner that he is one amongst the 2048 depositors. Since the investigation has not been expedited, he has sought for transfer of investigation to some other agency.

3. In my view, the respondents have taken positive steps by identifying the properties of the accused. Since the number of depositors are more than two thousand, it might take some more time to complete the investigation. In this background, it would not be appropriate for this Court to direct the transfer of investigation to some other agency, only at the instance of the petitioner, who is one among the 2048 depositors.

5. With these observation, the Criminal Original Petition stands dismissed. However, in view of the fact that complaint is pending from the year 2010 onwards, this Court directs the respondents to expedite the investigation and file a Final Report / Charge Sheet as early possible. 09.08.2017 Index : Yes/No ak To
