PRAYER:

Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the 1st respondent to consider the representation of the petitioners dated 26.12.2019 and include the name of the petitioners in the annexure to the Government Order in G.O.Ms.No.76, Municipal Administration and Water Supplies (TPI) Department, dated 31.05.2019 in the suitable place and effect promotion with attendant benefits on par with other employees as mentioned in the above Government Order.

O R D E R

By consent of both the parties, this writ petition is taken up for final disposal.

2. The limited prayer sought for in the present writ petition is for a direction to the first respondent to consider the representation of the petitioners dated 26.12.2019, wherein, they have sought for inclusion of their names in G.O.Ms.No.76, Municipal Administration and Water Supplies (TPI) Department, dated 31.05.2019, for the purpose of effecting promotion on par with other employees.

3. It is stated by the learned counsel for the petitioners that pending the writ petition, the petitioners' representation dated 26.12.2019 has been rejected by the first respondent herein on 30.06.2020.

4. In view of the said submission, no effective orders can be passed in the present writ petition, wherein, the main prayer itself has been dealt with by the first respondent. Nevertheless, if the petitioners are granted liberty to challenge the order of rejection passed passed by the first respondent, the ends of justice could be secured.

5. In the light of the above observation, the petitioners herein are granted liberty to challenge the rejection order passed by the first respondent dated 30.06.2020 in accordance with law. With such a liberty, the writ petition stands closed. No costs.
