Prayer: Second Appeal filed under Section 100 of C.P.C., against the decree and judgment dated 30.03.2004 passed in A.S.No.153 of 2003 on the file of the I Additional District Court, Coimbatore reversing the judgment and decree dated 14.12.2001 passed in O.S.No.784 of 1996 on the file of the II Additional Sub Court, Coimbatore.

J U D G M E N T

No representation for the appellant, despite the matter being called twice. From the notes paper, it is found that the death of the respondent had been reported long back and despite the above position, the appellant has not taken steps to bring the LR's on record and thereby proceed with the appeal in accordance with law. In such view of the matter, there is no purpose in keeping the Second Appeal further pending.

2. In the light of the above position, the second appeal is dismissed as abated.

No costs. Consequently, connected miscellaneous petition, if any, is closed.
