Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Declaration, declaring the fixation of date as 01.04.1998 in Para 4 of G.O.Ms.No.174 Finance (Pay Cell) Department dated 21.04.1998 for availing gratuity and commutation as illegal, void, ultra virus, in so far as the petitioners are concerned, who had retired before 01.04.1998, and extend all the pensionary benefits to the petitioners on par with the pensioners who had retired after 01.04.1998 with interest at 18% per annum till the date of actual payment.

ORDER
When the matter was taken up for consideration, the learned counsel for the petitioners, on instructions, submitted that the petitioners may be granted liberty to approach the respondent concerned with a fresh representation for appropriate relief.
2. The learned Additional Government Pleader appearing for the respondent has no serious objection for granting such relief to the petitioners.

In view of the above submissions made by the learned counsel on either side, this writ petition is closed, granting liberty to the petitioners to approach the respondent concerned afresh, if need be for appropriate remedy.
