Learned counsel for the respondents submit that the first respondent died as early as on 03.02.2009.

The learned counsel for the Appellant has also not taken steps to serve notice on R2 to R6 till date. The Second Appeal is of the year 2005. It can now be inferred that the Appellant https://hcservices.ecourts.gov.in/hcservices/

is not interested in prosecuting the Second Appeal. Accordingly, the Second Appeal is dismissed for non-prosecution. No costs.
