The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Section 303(2) of BNS read with Section 21(1) of MMDR Act in Crime No.330 of 2025, on the file of the respondent Police, seeks anticipatory bail.
2. The case of the prosecution is that based on the secret information, the respondent police went to the scene of occurrence and found that the petitioner had illegally transported 1 unit of river sand. Hence, the case.
3. This is the second anticipatory bail petition filed by the petitioner. The earlier anticipatory bail filed by the petitioner was dismissed by this Court in Crl.O.P.No.28991 of 2025 on 25.10.2025 by stating the following reasons:
Considering the nature of allegations, the submissions made by the learned counsels on either side, and considering the fact that the petitioner is not only illegally quarried river sand but also caused damage to the ecology and river bed, therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Now, without any change in circumstances, present petition is filed. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
