The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 191(2), 191(3), 126(2), 296(b), 232, 310(2), 311 & 351(3) of BNS in Crime No.04 of 2026, on the file of the respondent Police, seek anticipatory bail.
2. The allegation against the petitioner is that the petitioner one of the member of A1's group and they are facing several cases, out of which, one case is relating to the murder of the defacto complainant's brother-in-law, in which, defacto complainant's husband is a witness and in order to tamper the witness, petitioner along with other accused waylaid the defacto complainant and abused her in filthy language and also robbed a sum of Rs.3,500/- at knife point. Hence, the case.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case and he has not snatched any money from the defacto complainant. Hence, he prayed for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that, apart from this case, petitioner has involved in three other previous case. Hence, he opposed for grant of anticipatory bail to the petitioner.
5. Considering the nature of allegations and the bad antecedents against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
