O R D E R

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 117(2), 351(3) of BNS in Crime No.04 of 2026, on the file of the respondent Police, seek anticipatory bail.

2. The allegation against the petitioner is that due to money dispute, petitioner came to the house of the defacto complainant, who was already having poor health condition and attacked him and caused severe injuries, which resulted in amputation of leg. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has only helped the defacto complainant to reach his home and the only allegation is that he had pushed him. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that, injured is still taking treatment in the hospital and his legs got amputated. Hence, he opposed for grant of anticipatory bail to the petitioner.

5. Considering the nature of injuries sustained by the defacto complainant, in which, one of his legs got amputated, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 27.01.2026 sma
