The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 4(1)(i) of TNP Act r/w Section 4(1)(A) of TNP Amendment Act, 2024, in Crime No.10 of 2026 on the file of the respondent Police, seeks anticipatory bail. 1/4

The allegation against this petitioner is that, the petitioner joined hands with other accused and involved in transportation of 30 liquor bottles of 180 ml each for the purpose of selling the same. Hence, this case has been registered and A1 was arrested and from the statement of A1, it was came to know that the petitioner has also actively participated in the offence alleged.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution; only based on the confession statement, the petitioner was added as an accused since he has some previous cases, he was implicated in this case and that the petitioner is ready to abide by any conditions that may be imposed by this Court, hence sought for anticipatory bail to the petitioner. 4.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that there are 39 previous cases as against the petitioner, that the investigation of this case is pending. 2/4

Considering the submissions made on both sides and perused the materials available on record.

Considering the facts and circumstances of this case, gravity of offence, though it is stated that the petitioner has been falsely implicated in this case no material was produced to substantiate the same; and taking note of the fact that the investigation of the case is pending, this Court is not inclined to grant anticipatory bail to the petitioner. 7.
