ORDER

This writ petition has been filed for the issue of writ of mandamus directing the respondents to execute the deed of rectification by incorporating undivided share of 880 sq.ft.

2. Heard Mr.R.Sathyamurthy, learned counsel for the petitioner and Mr.D.Veerasekaran, learned Standing Counsel appearing for the respondent.

3. The learned Standing Counsel appearing for the Housing Board submitted that the rectification deed has already been executed on 07.03.2024 by incorporating the undivided share.

4. The learned counsel for the petitioner submitted that when the rectification deed was sought to be registered before the concerned SubRegistrar's Office, they were demanding exorbitant stamp duty and registration charges. It was therefore submitted that the petitioner should not be burdened with such costs for the mistake committed by the Housing Board.

5. In the considered view of this Court, the process from the side of the Housing Board has already been completed by means of executing a rectification deed. Only a fixed amount is payable to register a rectification deed. If an exorbitant amount is claimed from the petitioner, the petitioner has

to necessarily challenge such a claim made by the Sub-Registrar's office independently. That issue cannot be gone into in the present writ petition. However, liberty is granted to question the same.

6. In view of the above, this writ petition is disposed of. No costs. Consequently, the connected miscellaneous petitions, if any, are closed. 18-06-2025 gd Index:Yes/No Speaking/Non-speaking order Internet:Yes
