ORDER

The petitioner, who apprehends arrest for the alleged offence under Sections 39,50,51(1-c) of the wildlife ( protection) act in O.R.No.1 of 2026 on the file of the respondent seeks anticipatory bail. 1/4

2. The case of the prosecution is that his petitioner has planted country bomb in the Sathyamangalam Reserve Forest area, due to which 3 years old elephant died. Hence the case has been registered.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to abide by any other stringent conditions that may be imposed by this Court. Hence, prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that one of the accused in this case has been arrested and this petitioner has been actively participated in the crime. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record. 2/4

Considering the submissions made by both sides and the nature of offence and the petitioner being well aware of the fact that the act of planting country made gun will affect the wild animals, has involved in such kind of offence and 3 year old elephant was died, this Court is not inclined to grant anticipatory bail to the petitioner.
